Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of okmentor (the "Service"), a 1-on-1 mentorship booking platform operated by Eugeniuses ("we", "us", or "our"), located at 1524 Chemin de Stratford, Frontenac, QC J0B 2K0, Canada.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Description of the Service

okmentor is a platform that enables mentors to create professional profiles, list their services, set their availability, and accept bookings from individuals seeking 1-on-1 mentorship sessions. Bookers can browse mentor profiles, select services, schedule sessions, and pay securely through the platform.

okmentor acts as an intermediary platform — we facilitate the connection between mentors and bookers but are not a party to the mentorship sessions themselves.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account Registration

To offer mentorship services on okmentor, you must create a mentor account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account.

5. Mentor Responsibilities

As a mentor using the Service, you agree to:

• Provide accurate and truthful information in your profile, including qualifications, certifications, and service descriptions.
• Offer only lawful services that comply with applicable regulations in your jurisdiction.
• Honor confirmed bookings or provide timely notice of cancellations in accordance with your stated cancellation policy.
• Handle any personal data shared by bookers during sessions in compliance with applicable privacy laws.
• Set fair and transparent pricing for your services.

6. Booker Responsibilities

As a booker using the Service, you agree to:

• Provide accurate contact information when making a booking.
• Attend scheduled sessions on time or cancel in accordance with the mentor's cancellation policy.
• Use the Service for lawful purposes only and treat mentors with respect.
• Not misuse or redistribute any content or advice received during mentorship sessions.

7. Fees and Payment

7.1 Pricing

Mentors set their own pricing for each service they offer. All prices are displayed in the currency configured by the mentor and are inclusive of the mentor's stated fees.

7.2 Payment Processing

Payments are processed securely through Stripe Connect. By making a payment, you agree to Stripe's Terms of Service. okmentor does not store your full payment card details.

7.3 Platform Fee

okmentor may charge a platform fee on transactions. Any applicable fees will be clearly disclosed before payment is completed.

7.4 Cancellations and Refunds

Cancellation and refund policies are set by individual mentors and displayed on their service pages. Bookers are responsible for reviewing these policies before confirming a booking. okmentor is not responsible for disputes between mentors and bookers regarding cancellations or refunds, but may assist in mediation at its discretion.

8. Data Ownership

Mentors retain ownership of all content they create on the platform, including profile information, service descriptions, and any materials shared during sessions. okmentor is granted a limited, non-exclusive license to display this content on the platform for the purpose of providing the Service.

9. Intellectual Property

The Service, including its design, code, logos, and documentation, is the intellectual property of Eugeniuses and is protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

10. Acceptable Use

You agree not to:

• Use the Service for any unlawful, fraudulent, or harmful purpose.
• Impersonate any person or entity or misrepresent your affiliation.
• Interfere with or disrupt the Service or its infrastructure.
• Attempt to gain unauthorized access to any part of the Service.
• Scrape, harvest, or collect data from the Service without authorization.
• Post or transmit any content that is offensive, defamatory, or infringes on the rights of others.

11. Service Availability

We strive to maintain the availability of the Service but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We shall not be liable for any downtime or service interruptions.

12. Limitation of Liability

To the maximum extent permitted by law, Eugeniuses and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

okmentor is not responsible for the quality, accuracy, or legality of mentorship services provided by mentors, nor for any interactions or disputes between mentors and bookers.

13. Indemnification

You agree to indemnify, defend, and hold harmless Eugeniuses and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your infringement of any rights of a third party.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect.

You may delete your account at any time through your dashboard settings. Upon account deletion, your profile and services will be removed from the platform, subject to our data retention obligations described in our Privacy Policy.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the Province of Quebec.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
